The European Committee of Social Rights published its 2022 conclusions on Slovakia

The European Committee of Social Rights published its conclusions in respect of 33 states, including Slovakia on the articles of the European Social Charter relating to Labour Rights (Group 3).

The Government of the Slovak Republic submitted its 12th National Report to the European Committee of Social Rights in February 2022 (available on the webpage of the Council of Europe). The Centre sent its Comments in June 2022 (available on our webpage). In our report, we focused mainly on the implementation of selected provisions by the Slovak Republic – the right to a fair remuneration – Article 4 (3); the right to dignity at work – Article 26; and the right to information and consultation in collective redundancy procedures – Article 29 of the European Social Charter (revised).

In March 2023, the Committee of Social Rights published its conclusions for Slovakia (available on the webpage of the Council of Europe) on 23 provisions of the European Social Charter (revised) in the group of Labour Rights for the years 2017-2020. Regarding Slovakia, the Committee concluded that the situation was in conformity with the Charter with regards to 10 articles (Art. 2/2, Art. 2/3, Art. 2/4, Art. 2/6, Art. 2/7, Art. 4/2, Art. 6/2 and Art. 6/3) and deferred its conclusion pending receipt of information regarding 6 articles (Art. 2/1, Art. 4/1, Art. 4/3, Art. 5, Art. 6/1 and Art. 29) The Committee found the situation in Slovakia not in comformity with the European Social Charter (revised) regarding 7 articles:

  • Article 2 (5): Right to just conditions of work – Weekly rest period
  • Article 4 (4): Right to a fair remuneration – Reasonable notice of termination of employmente
  • Article 4 (5): Right to a fair remuneration – Limits to deduction from wages
  • Article 6 (4): Right to bargain collectively – Collective action
  • Article 26 (1): Right to dignity in the workplace – Sexual harassment
  • Article 26 (2): Right to dignity in the workplace – Moral harassment
  • Article 28: Right of workers’ representatives to protection in the undertaking and facilities to be accorded to them

In 2023, the European Committee of Social Rights will examine the compliance of the national situations with the Charter in the thematic group 4 on children, families and migrants. The Slovak Republic sent its National Report in February 2023 (available on the webpage of the Council of Europe) and the reports of other actors, including civil society organizations can be sent until 30 June 2023.
