{"id":9498,"date":"2022-12-21T17:03:30","date_gmt":"2022-12-21T16:03:30","guid":{"rendered":"https:\/\/www.snslp.sk\/?post_type=sledovanie-prav&#038;p=9498"},"modified":"2024-07-11T10:25:16","modified_gmt":"2024-07-11T08:25:16","slug":"the-existence-of-institutional-mechanisms-to-prevent-and-fight-against-corruption-evaluation-comming-soon","status":"publish","type":"sledovanie-prav","link":"https:\/\/www.snslp.sk\/en\/sledovanie-prav\/the-existence-of-institutional-mechanisms-to-prevent-and-fight-against-corruption-evaluation-comming-soon\/","title":{"rendered":"The existence of institutional mechanisms to prevent and fight against corruption"},"content":{"rendered":"\n<p>The <a href=\"https:\/\/www.nrsr.sk\/web\/Default.aspx?sid=zakony\/cpt&amp;ZakZborID=13&amp;CisObdobia=9&amp;ID=106\">amendment<\/a> to the criminal law system introduced by the Slovak government thought accelerated legislative procedure in December 2023 amends the criminal procedural law resulting the abolishment of the Special Prosecutor&#8217;s Office of the Slovak Republic.<\/p>\n\n\n\n<p>The Special Prosecutor&#8217;s Office prosecuted persons suspected of committing crimes and falling under the jurisdiction of the Specialized Criminal Court, including the most serious corruption offences.<\/p>\n\n\n\n<p>According to the letter by the European Chief Prosecutor addressed to the European Commission in December 2023, the proposed amendments constitute a serious risk of breaching the rule of law by:<\/p>\n\n\n\n<ul><li>minimizing detection of potential fraud affecting the financial interests of the EU;<\/li><li>disrupting functional reporting lines established between the European Public Prosecutor&#8217;s Office and the Special Prosecution Service;<\/li><li>cutting the EPPO from the specialized investigators of the National Criminal Agency, without adequate replacement;<\/li><li>rerouting most of the European Public Prosecutor&#8217;s Office cases from the Specialized Penal Court to lower courts, with little expertise in crimes under the competence of the European Public Prosecutor&#8217;s Office;<\/li><li>and constituting a de facto amnesty in a substantial number of active investigations into fraud affecting the financial interests of the EU in the Slovak Republic.<\/li><\/ul>\n\n\n\n<p>Moreover, such significant change is being done through an accelerated legislative procedure and raising concerns as to its compliance&nbsp;with obligation laid down in Article 4(3) TEU that includes a mutual legal obligation for the EU and its Member States to assist each other in carrying out the tasks stemming from the Treaties.<\/p>\n","protected":false},"author":3,"featured_media":0,"template":"","kategorie-prav-taxonomy":[149],"_links":{"self":[{"href":"https:\/\/www.snslp.sk\/en\/wp-json\/wp\/v2\/sledovanie-prav\/9498"}],"collection":[{"href":"https:\/\/www.snslp.sk\/en\/wp-json\/wp\/v2\/sledovanie-prav"}],"about":[{"href":"https:\/\/www.snslp.sk\/en\/wp-json\/wp\/v2\/types\/sledovanie-prav"}],"author":[{"embeddable":true,"href":"https:\/\/www.snslp.sk\/en\/wp-json\/wp\/v2\/users\/3"}],"wp:attachment":[{"href":"https:\/\/www.snslp.sk\/en\/wp-json\/wp\/v2\/media?parent=9498"}],"wp:term":[{"taxonomy":"kategorie-prav-taxonomy","embeddable":true,"href":"https:\/\/www.snslp.sk\/en\/wp-json\/wp\/v2\/kategorie-prav-taxonomy?post=9498"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
