The aim of this publication is to guide the reader in a clear way through how the
\nCharter is applied in the Slovak Republic and how it benefits the holders of the fundamental rights it contains.<\/p>\n

The contribution of the Charter is illustrated in particular by presenting real examples from practice where the Court
\nof Justice of the European Union (\u201cCJEU\u201d) has granted protection of fundamental
\nrights through direct application of the Charter at the national level. It also introduces a practical set of control questions to assess the compliance of national measures with the Charter. A special space is devoted to the issue of EU funds, since in the current programming period their use is linked to the condition of respecting the fundamental rights in the Charter.<\/p>\n <\/div>\n <\/div>\n \n\n \n \n \n\n

The study analyses the institutional structure of the protection of human rights in the Slovak Republic through an analysis of the mandates of individual national institutions and public authorities.<\/p>\n

In the Slovak Republic, every single public authority is obliged to implement human rights. Thus, a comprehensive picture of the structure of fundamental rights protection in the Slovak Republic encompasses institutions independent of the state whose primary mission is to protect fundamental rights and freedoms, public authorities to which the law explicitly entrusts competences in the field of human rights, public authorities and institutions that ensure the protection of fundamental rights within their specific mandate, and governmental advisory bodies whose role is to promote various policies related to human rights in the state policy.<\/p>\n

The Study also provides information on procedures through which an individual can approach these institutions or public authorities. A key strategic document in the field of fundamental rights protection, namely the National Strategy for the Protection and Promotion of Human Rights is also considered. The Study concludes with a final analysis of the nature of the mandate of national institutions within the human rights protection architecture and provides concluding recommendations for these institutions.<\/p>\n <\/div>\n <\/div>\n \n\n \n \n \n\n

As part of the project, the Centre prepared a Report on the role of national human rights institutions in ensuring respect for fundamental rights in the implementation of EU funds in Slovakia. By adoption of the new Common Provisions Regulation for the implementation of EU funds (\u201cCommon Provisions Regulation\u201d),1<\/sup>\u00a0respect for fundamental rights has now become an essential condition for the implementation of EU funds.<\/p>\n

The report focuses on the potential role of the Centre in implementing the fundamental rights conditionality, based on an analysis of the structure of the implementation of European Union funds in the Slovak Republic. The aim of the report is therefore to examine the role that the Centre could play in fulfilling its mandate as a national human rights institution in the process of implementing EU funds respecting the new human rights conditionality.<\/p>\n

Concerning the methodology and the scope, the purpose of the report is to provide an overview of how EU funds operate in a national context, in order to identify fundamental rights challenges and opportunities, and to examine the role and involvement of national authorities with human rights remit in ensuring that EU funds comply with fundamental rights.<\/p>\n

Based on the results of its desk research, the Centre also identified key stakeholders and experts at national level and conducted expert interviews to obtain an overview of fundamental rights challenges and opportunities in the implementation of EU funds, and to further explore the role of national authorities with human rights remit in ensuring respect for fundamental rights when implanting EU funds.<\/p>\n

In preparing the Report, the Centre interviewed:<\/p>\n

  1. the relevant departments of the Ministry of Labour, Social Affairs and Family \u2013 the Gestor of the Horizontal Principles which has been mandated to ensure compliance of EU funds with the basic horizontal conditions regarding compliance with the Charter of Fundamental Rights of the European Union and the UN Convention on the Rights of Persons with Disabilities,<\/li>\n
  2. the Office of the Government Plenipotentiary for Roma Communities, which acts as one of the ten intermediate bodies,<\/li>\n
  3. Ministry of Education, Science, Research and Sport of the Slovak Republic, which acts as one of the ten intermediate bodies as well,<\/li>\n
  4. Ministry of Investments, Regional Development and Informatization of the Slovak Republic, which acts as the managing authority.<\/li>\n<\/ol>\n

    \u010co sa t\u00fdka metodiky a rozsahu, \u00fa\u010delom Spr\u00e1vy je poskytn\u00fa\u0165 preh\u013ead o tom, ako finan\u010dn\u00e9 prostriedky E\u00da funguj\u00fa vo vn\u00fatro\u0161t\u00e1tnom kontexte, identifikova\u0165 v\u00fdzvy a pr\u00edle\u017eitosti v oblasti z\u00e1kladn\u00fdch pr\u00e1v a presk\u00fama\u0165 \u00falohu a zapojenie vn\u00fatro\u0161t\u00e1tnych org\u00e1nov s pr\u00e1vomocou v oblasti \u013eudsk\u00fdch pr\u00e1v pri zabezpe\u010dovan\u00ed s\u00faladu finan\u010dn\u00fdch prostriedkov E\u00da so z\u00e1kladn\u00fdmi pr\u00e1vami.<\/p>\n

    Na z\u00e1klade v\u00fdsledkov teoretick\u00e9ho v\u00fdskumu SNS\u013dP taktie\u017e identifikovalo k\u013e\u00fa\u010dov\u00e9 zainteresovan\u00e9 strany a odborn\u00edkov na vn\u00fatro\u0161t\u00e1tnej \u00farovni a\u00a0uskuto\u010dnilo odborn\u00e9 rozhovory s cie\u013eom z\u00edska\u0165 preh\u013ead o v\u00fdzvach a pr\u00edle\u017eitostiach v oblasti z\u00e1kladn\u00fdch pr\u00e1v pri implement\u00e1cii finan\u010dn\u00fdch prostriedkov E\u00da\u00a0 a \u010falej presk\u00fama\u0165 \u00falohu vn\u00fatro\u0161t\u00e1tnych org\u00e1nov s pr\u00e1vomocou v oblasti \u013eudsk\u00fdch pr\u00e1v pri zabezpe\u010dovan\u00ed dodr\u017eiavania z\u00e1kladn\u00fdch pr\u00e1v pri implant\u00e1cii fondov E\u00da.<\/p>\n

      The report focuses on the fundamental rights situation through an analysis of the implementation of the Charter by the judiciary, executive and legislative powers in Slovakia. It provides information on how the Charter should be used in law-making process and how it is actually used. In particular, the study focuses on the process of adopting new civil codes. It also examines the way in which national policies refer to the Charter, whether they directly implement the Charter or only make formal reference to it. In the area of the judiciary, the study specifically examines the use of the Charter by the courts of the general court system and by the Constitutional Court of the Slovak Republic through specific court decisions referring to the Charer. Finally, it presents examples of good practice from other EU Member States in the implementation of the Charter.
